Easements


An easement is an incorporeal right enjoyed by the owner of a legal estate (dominant tenement) over land in the ownership of another person (servient tenement) that binds successors in title.

Easements are usually positive, giving the dominant owner the right to enter or use the servient land in some way (eg a right of way). However, they can be negative preventing something being done on the servient land and so giving the dominant owner the right to receive something from the servient land (eg a right to light).

Nature and characteristics of an easement

The four essential characteristics of an easement are:

  1. •

    there must be a dominant and a servient tenement

  2. •

    the easement must accommodate the dominant tenement

  3. •

    the dominant and servient owners must be different persons, and

  4. •

    the easement must be capable of forming the subject matter of a grant

Law Society publishes new practice note on climate risk and conveyancing

The Law Society has published a new practice note, providing practical guidance for solicitors and their teams on addressing climate-related risks in property transactions, including residential, commercial, and mixed-use properties. The note covers examples of climate risks, how to advise and represent clients in different transactions, and approaches to valuations and surveys. It is intended for firms of all sizes, regardless of their area of specialisation. It follows the Law Society’s consultation, conducted from 17 September to 31 October 2024, which involved engagement with 20 industry bodies.

HM Land Registry updates Practice Guide 67

HM Land Registry has updated Practice Guide 67—Evidence of identity. Section 6.3 has been amended to include a reference to form ID3, which must be uploaded when a non-conveyancer verifies an individual’s identity to support a change of name application.

Law Society issues update on TA6 form following NTSELAT withdrawal of material information guidance

The Law Society has issued an update on the TA6 Property information form, following the National Trading Standards Estate and Letting Agency Team (NTSELAT)’s withdrawal of its material information guidance on 8 May 2025. The Law Society is urgently seeking clarification from NTSELAT on the implications of this withdrawal for its members and the wider conveyancing profession. In the interim, work to improve the TA6 form will proceed as planned, and conveyancers can continue using either the fourth edition (second revision, 2020) or the fifth edition (2024) of the form, both of which remain compliant with the Law Society’s Conveyancing Quality Scheme.

NTS announces withdrawal of material information guidance for estate and letting agents

The National Trading Standards (NTS) has announced the withdrawal of its guidance on material information for estate and letting agents, following the replacement of the Consumer Protection from Unfair Trading Regulations 2008, SI 2008/1277, by the new Digital Markets, Competition and Consumers Act 2024 (DMCCA 2024). The guidance was originally developed to help estate and letting agents comply with their obligations under SI 2008/1277.
